Terms and Conditions

Effective Date: November 27, 2025
 Applies to: All users of Kaya Ko Yan! (“KKY”), including buyers and creators.

1. Acceptance of Terms

By accessing or using Kaya Ko Yan!, you agree to comply with these Terms and Conditions, our Refund Policy, and our Privacy Policy. If you do not agree, you must stop using the platform immediately.

2. Nature of the Platform

  • Kaya Ko Yan! (“KKY”) is a digital marketplace where creators offer digital products, creative services, professional services, and event tickets.

     

  • KKY acts as an intermediary platform. Transactions are strictly between buyers and creators.

     

  • KKY does not guarantee the quality, legality, or accuracy of any listing. However, we enforce policies to protect both buyers and creators.

     

3. User Eligibility

  • Users must be at least 18 years old to create an account.

     

  • Users must provide accurate and truthful personal and business information.

     

  • Creators must have the legal right to sell their products or services.

     

4. Creator Obligations

  • Creators must:

     

    • Upload only original or licensed content.

       

    • Provide accurate descriptions, prices, and delivery timelines.

       

    • Deliver products and services as advertised.

       

  • Creators may not:

     

    • Upload pirated or illegal materials.

       

    • Sell physical products (KKY is digital-first).

       

    • Circumvent the platform by taking payments outside KKY.

       

  • KKY reserves the right to remove any listing that violates these obligations.

     

5. Buyer Responsibilities

  • Buyers must:

     

    • Pay in full at checkout using approved payment gateways (GCash, Maya, credit/debit cards, bank transfer).

       

    • Provide correct details for delivery of digital products or services.

       

  • Buyers may not:

     

    • Request or encourage off-platform transactions.

       

    • Redistribute or resell products without creator permission.

       

    • Harass or abuse creators or other users.

6. Commissions and Fees

  • Kaya Ko Yan! (“KKY”) charges commission on every sale made through the platform.

     

  • All commissions and fees are VAT-exclusive. A 12% Value-Added Tax (VAT) will be added to KKY’s commission/fees in compliance with Philippine tax laws.

     

  • Commission rates are as follows:

     

    • Basic Creators:

       

      • Learn (Digital Products) → 15%

         

      • Create (Creative Services) → 15%

         

      • Grow (Professional Services / Events) → 18%

         

      • Event Tickets → 8%
    • Pro Creators:

       

      • Learn (Digital Products) → 12%

         

      • Create (Creative Services) → 12%

         

      • Grow (Professional Services / Events) → 15%

         

      • Event Tickets → 5%

         

  • Example: A ₱1,000 order in the Learn category under Basic will incur ₱150 commission + ₱18 VAT (12%), for a total fee of ₱168.

     

  • Payment processor fees (e.g., 2.9% + ₱15 per transaction) are also deducted from payouts.

     

  • Subscription fees for KKY Pro are VAT-exclusive. 12% VAT is added to the monthly subscription fee upon billing.

     

7. Refunds and Disputes

  • Refunds are governed by the KKY Refund Policy.

     

  • Buyers and creators must first attempt to resolve disputes via the platform.

     

  • If unresolved, KKY will mediate. Both parties must provide evidence.

     

  • KKY’s decision on refunds and disputes is final and binding.

     

8. Payouts to Creators

  • Basic Creators: payouts within 7–14 days after order completion.

     

  • Pro Creators: payouts within 24–48 hours after order completion.

     

  • Minimum withdrawal: ₱500.

     

  • Supported payout channels: GCash, Maya, PH banks.

     

  • KKY may hold funds if fraud, disputes, or policy violations are suspected.

     

9. Intellectual Property

  • All products must be original or properly licensed.

     

  • Buyers receive only a license to use, not ownership.

     

  • Redistribution, resale, or piracy is strictly prohibited.

     

  • KKY respects copyright law and will honor valid takedown requests.

     

10. Verification and Trust

  • KKY may require ID verification for certain creators.

     

  • Verified creators may receive badges and improved visibility.

     

  • Submitting false verification documents is grounds for permanent ban.

     

11. Prohibited Conduct

  • Circumventing fees by moving transactions off-platform.

     

  • Uploading illegal, harmful, or misleading content.

     

  • Engaging in harassment, hate speech, or fraudulent activity.

     

  • Manipulating reviews or ratings.

     

  • Uploading viruses, malware, or malicious files.

     

12. Liability Disclaimer

  • KKY is not responsible for:

     

    • The quality or delivery of products/services (these remain creator obligations).

       

    • Buyer misuse of digital products.

       

    • Indirect or consequential damages from use of the platform.

       

  • KKY’s liability is limited strictly to platform fees collected.

     

13. Account Suspension and Termination

  • KKY reserves the right to suspend or terminate accounts that:

     

    • Violate these Terms.

       

    • Engage in fraudulent activity.

       

    • Repeatedly receive refund disputes.

       

  • Funds from fraudulent transactions may be forfeited.

     

14. Changes to Terms

  • KKY may update these Terms and Conditions from time to time.

     

  • Continued use of the platform after changes means you accept the updated Terms.

     

15. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Republic of the Philippines.

     

  • Any disputes shall be subject to the jurisdiction of Philippine courts.
